1. Agreement to These Terms

These Terms & Conditions (“Terms”) govern your access to and use of acaringtouchforseniors.com (the “Site”), operated by A Caring Touch for Seniors, LLC, owner of the registered trademark A CARING TOUCH FOR SENIORS® (“A Caring Touch for Seniors,” “we,” “us,” or “our”).

By accessing the Site, submitting a form, or contacting us through the Site, you agree to these Terms and to our Privacy PolicyIf you do not agree, do not use the Site.

These Terms apply to the Site only. Services we provide to clients are governed by a separate written service agreement.

2. Who We Are

A Caring Touch for Seniors, LLC is a Georgia private home care provider based in Marietta, Georgia, serving families throughout Georgia. We provide in-home personal care, companion care, dementia care, and related services, and we participate in certain Georgia Medicaid waiver programs.

3. Informational Purpose Only — No Medical Advice

The content on this Site is provided for general informational purposes only.

Nothing on this Site is medical advice, nursing advice, legal advice, tax advice, or financial advice. Nothing on this Site is a substitute for consultation with a qualified physician, nurse, attorney, accountant, benefits counselor, or other licensed professional.

Using this Site, submitting a form, or contacting us does not create a provider-patient relationship, a caregiver relationship, or any service relationship between you and A Caring Touch for Seniors. A service relationship begins only when both parties sign a written service agreement and services commence.

4. No Guarantee of Eligibility, Enrollment, Benefits, or Payment

This section is important. Please read it carefully.

4.1 Government programs are administered by government agencies, not by us. The Georgia Community Care Services Program (CCSP), the Service Options Using Resources in a Community Environment (SOURCE) waiver, Structured Family Caregiving (SFC), the Elderly and Disabled Waiver Program (EDWP), Georgia Medicaid, and U.S. Department of Veterans Affairs benefits are administered by the Georgia Department of Community Health, the Georgia Department of Human Services, the Centers for Medicare & Medicaid Services, and the U.S. Department of Veterans Affairs — not by A Caring Touch for Seniors.

4.2 We do not determine eligibility. Eligibility for any government program is determined solely by the responsible government agency, based on its own criteria, its own assessment process, and its own review of your circumstances. Nothing on this Site — including any eligibility screening form, checklist, or description of program requirements — is an eligibility determination, an approval, an enrollment, or a promise of any kind.

4.3 Program rules change. Eligibility criteria, covered services, payment rates, stipend amounts, and program availability are set by government agencies and are subject to change without notice. Information on this Site is believed accurate as of the date published but may become outdated. Always confirm current requirements directly with the Georgia Department of Community Health, Georgia Medicaid, or the U.S. Department of Veterans Affairs.

4.4 We make no promise of payment or payment amount. Any caregiver stipend, reimbursement, or payment referenced anywhere on this Site is set by the applicable program, varies by the participant’s assessed level of care and other factors, and is not guaranteed. We do not guarantee that any person will be approved for any program, will receive any payment, or will receive any particular amount.

4.5 Waiting lists and capacity. Program enrollment may be subject to waiting lists, funding limits, capacity limits, and geographic availability. We cannot guarantee that services will be available to you or in your area.

4.6 Tax treatment. Any statement on this Site regarding the tax treatment of caregiver payments is general information only, not tax advice. Tax treatment depends on your individual circumstances. Consult a qualified tax professional.

5. Accuracy of Site Content

We make reasonable efforts to keep the Site accurate and current. We do not warrant that the content is complete, accurate, current, or error-free. We may change, correct, or remove content at any time without notice. Any reliance you place on Site content is at your own risk.

6. Permitted Use of the Site

You may use the Site for lawful personal purposes only, to learn about our services and to contact us.

You agree not to: – Use the Site for any unlawful purpose or in violation of these Terms – Submit false, misleading, or fraudulent information – Submit another person’s information without their authorization – Attempt to gain unauthorized access to the Site, our systems, or any account – Introduce viruses, malware, or other harmful code – Use automated means to scrape, harvest, or collect data from the Site – Interfere with or disrupt the Site’s operation or security – Copy, reproduce, or republish Site content except as permitted in Section 7 – Use the Site to send unsolicited commercial communications – Impersonate A Caring Touch for Seniors or any of our staff

We may suspend or terminate your access to the Site at any time, without notice, for any reason.

7. Intellectual Property

The Site and its content — including text, graphics, logos, photographs, icons, and page layouts — are owned by A Caring Touch for Seniors, LLC or its licensors and are protected by U.S. copyright, trademark, and other intellectual property laws.

A CARING TOUCH FOR SENIORS® is a registered trademark of A Caring Touch for Seniors, LLC, registered on the Principal Register of the United States Patent and Trademark Office under Registration No. 8,312,230 (wordmark) and Registration No. 8,312,308 (design/logo mark), in International Class 45.

Any unauthorized use, reproduction, imitation, or registration of these marks, or of any mark confusingly similar to them, is prohibited and may constitute trademark infringement under the Lanham Act and applicable state law. We actively monitor and enforce our trademark rights.

You may view, download, and print Site content for your own personal, non-commercial use. You may not otherwise copy, modify, distribute, publish, display, sell, or create derivative works from Site content, and you may not use our name, marks, or logo, without our prior written permission.

Third-party names, marks, and content referenced on the Site — including references to the Alzheimer’s Association, Georgia Department of Community Health, Medicaid, or the U.S. Department of Veterans Affairs — belong to their respective owners. Reference to them does not imply endorsement, affiliation, or sponsorship unless expressly stated.

8. Information You Submit

When you submit information through a form, email, phone call, or text message, you represent that: – The information is accurate and complete to the best of your knowledge – You are at least 18 years old – If you are providing information about another person, you have that person’s authorization to do so

Do not submit Social Security numbers, Medicaid or insurance identification numbers, medical records, medical diagnoses, or other highly sensitive information through this Site. Our forms are not designed to receive that information. If we need it, we will collect it securely after we speak with you.

We handle information you submit in accordance with our Privacy Policy. By submitting a form, you consent to being contacted as described in the consent language presented with that form.

9. Messaging Terms — SMS Terms of Service

This Section 9 is our SMS Terms of Service. Text messages are sent through RingCentral.

9.1 Program description

A Caring Touch for Seniors, LLC operates a text messaging program that sends: customer care replies, care inquiry follow-up, appointment and scheduling messages, account and service notifications, program and eligibility updates related to Georgia Medicaid waiver programs, employment and recruiting messages to job applicants, and — for those who separately opt in — marketing and educational messages about home care services, caregiver resources, company news, and special offers.

9.2 How to opt in

You may opt in by checking the optional SMS consent box on a form on this Site, by giving verbal or written consent to our staff, or by texting us first at 770-627-4748. Consent to receive text messages is not a condition of purchasing any goods or services, of receiving care from us, or of employment with us.

9.3 Message frequency

Message frequency varies based on your interaction with us and the message categories you opted in to.

9.4 Cost

Message and data rates may apply. These charges are set by your mobile carrier and are your responsibility. Contact your carrier for details about your plan.

9.5 How to opt out

Reply STOP to any message to cancel. After you send STOP, we will send one confirmation message and you will receive no further texts, unless you opt in again. You may also opt out by emailing info@acaringtouchforseniors.com or calling 770-627-4748.

9.7 Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, and U.S. Cellular, among others; carrier participation may change without notice.

9.8 Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. No mobile opt-in or text message consent will be shared with third parties or affiliates for marketing purposes. See Section 6 of our Privacy Policy for full details.

9.9 Do not send sensitive information by text

Text messaging is not a secure channel. Do not send Social Security numbers, Medicaid or insurance identification numbers, medical records, or detailed health information by text message. If you are a client and need to discuss protected health information, call us at 770-627-4748.

9.10 Phone calls

By providing your phone number and consenting, you agree we may call you about your inquiry and requested services, including through an automated telephone dialing system. You may withdraw consent to calls at any time by telling any staff member, emailing us, or calling 770-627-4748.

10. Employment Applications

Submitting an employment application through the Site does not create an offer of employment, a promise of employment, or an employment contract. All employment with A Caring Touch for Seniors, LLC is at-will unless otherwise stated in a signed written agreement. Employment is contingent on satisfactory completion of background checks, credential verification, and health screening as required by Georgia law and our policies. 11. Third-Party Websites and Links

The Site contains links to third-party websites, including social media platforms and government resources. We do not control and are not responsible for the content, accuracy, availability, or privacy practices of those sites. Links are provided for convenience only and do not constitute endorsement. Accessing third-party sites is at your own risk.

12. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, A Caring Touch for Seniors, LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that defects will be corrected.

This Section 12 applies to the Site only. It does not limit or disclaim any warranty, standard of care, or obligation applicable to home care services we actually provide to clients under a signed service agreement, and it does not limit any right you have under Georgia law governing licensed home care providers.

13. Limitation of Liability

To the fullest extent permitted by law, A Caring Touch for Seniors, LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or related to your use of, or inability to use, the Site, whether based in contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or related to the Site will not exceed one hundred U.S. dollars ($100.00).

Nothing in this Section 13 limits our liability for gross negligence, willful misconduct, personal injury, or death caused by our acts or omissions, or for any liability that cannot be limited or excluded under applicable law. This Section applies to the Site only and does not limit our liability arising from home care services provided to clients under a signed service agreement.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless A Caring Touch for Seniors, LLC and its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses — including reasonable attorneys’ fees — arising out of or related to your misuse of the Site, your violation of these Terms, your violation of any law, or your infringement of any third party’s rights.

15. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Cobb County, Georgia, and you consent to the personal jurisdiction of those courts.

16. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

17. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and A Caring Touch for Seniors, LLC regarding your use of the Site, and supersede any prior agreements or understandings regarding the Site. They do not supersede any signed service agreement or employment agreement between us.

19. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site and revising the “Last Updated” date. Material changes will be highlighted. Your continued use of the Site after an update means you accept the revised Terms.
