A Caring Touch for Seniors, LLC, owner of the registered trademark A CARING TOUCH FOR SENIORS® (“A Caring Touch for Seniors,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you visit acaringtouchforseniors.com (the “Site”), submit a form, call or text us, or apply for employment with us.

By using the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

Important — this policy covers our website, not your medical records. If you become a client of A Caring Touch for Seniors, health information we create or receive in the course of providing care is protected health information (“PHI”) governed by the Health Insurance Portability and Accountability Act (“HIPAA”) and is handled under our Notice of Privacy Practices, which is provided to clients separately at the start of service. This Privacy Policy does not replace that notice.

3. Information We Collect

3.1 Information you give us directly

When you submit a contact or care inquiry form, we collect: – Your name – Your email address – Your phone number – Your preferred time to be contacted – Any message or description of care needs you choose to provide

When you submit our Structured Family Caregiving eligibility form, we collect the above plus your answers to these screening questions: – Whether you are the person who needs care – Whether the person who needs care has Georgia Medicaid – Whether the caregiver and the person who needs care live in the same home

These screening answers help us determine whether we can assist you. We do not ask for Social Security numbers, Medicaid identification numbers, medical diagnoses, or medical records through our website forms. Please do not submit that information through the Site. If we need it, we will collect it securely and directly after we speak with you.

When you apply for employment with us, we collect the information requested on the application, which may include your name, contact information, address, work history, professional references, education, certifications and licenses, driving and insurance information, availability, and required health screening documentation. Employment application data is used only for hiring and employment purposes.

When you call, text, or email us, we collect the contents of that communication and the contact information you use.

3.2 Information collected automatically

  • Evaluate employment applications
  • Operate, maintain, secure, and improve the Site
  • Measure and improve the performance of our advertising
  • Comply with legal, regulatory, licensing, and contractual obligations, including those applicable to Georgia licensed home care providers
  • Detect, prevent, and respond to fraud, abuse, or security incidents

6. Text Messaging (SMS) and Phone Calls

A Caring Touch for Seniors, LLC sends text messages using RingCentral. This section is our SMS program disclosure.

6.1 How you opt in

You may opt in to
receive text messages from us by: – Checking the SMS consent box on a form on this Site (the box is optional and is not pre-checked) – Giving verbal or written consent to a member of our staff during a phone call, an in-home assessment, or at our office – Texting us first at 770-627-4748

Consent to receive text messages is never a condition of receiving care, services, or employment from us.

6.2 What types of messages we send

If you opt in, you may receive the following categories of text message:

  • Customer care and conversational messages — replies to questions you send us
  • Care inquiry follow-up — responses to a form you submitted, and follow-up about your request for care
  • Appointment and scheduling messages — confirmations, reminders, and changes for in-home assessments, caregiver visits, and office appointments
  • Account and service notifications — schedule changes, caregiver assignment updates, and service-related notices
  • Program and eligibility updates — status updates related to Georgia Medicaid waiver programs you have asked us about
  • Employment and recruiting messages — if you applied for a job with us: interview scheduling, application status, and onboarding steps
  • Marketing and educational messages — home care information, caregiver resources, company news, and special offers. You receive these only if you separately opted in to marketing communications.

6.3 Message frequency, rates, and how to stop

  • Message frequency varies depending on your interaction with us and the type of messages you opted in to receive.
  • Message and data rates may apply. Charges are set by your mobile carrier, not by us.
  • To opt out, reply STOP to any message from us. You will receive one confirmation message and no further messages, unless you opt in again.
  • For help, reply HELP to any message, email info@acaringtouchforseniors.com, or call 770-627-4748.
  • Carriers are not liable for delayed or undelivered messages.
  • Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and others. Carrier support may change.

6.4 Mobile information sharing — our commitment

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

All of the information-sharing categories described in Section 7 of this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Information obtained as part of the SMS consent process — including your phone number, the fact that you opted in, and the date and method of your consent — is not shared with, sold to, or rented to any third party or affiliate for any purpose. It is used only to deliver the messages you requested through our messaging provider and to maintain our own compliance records.

6.5 Phone calls

If you provide your phone number, we may call you about your inquiry and requested services, including through an automated telephone dialing system where you have consented to that. You may ask us to stop calling at any time by telling any staff member, emailing us, or calling 770-627-4748.

7. How We Share Your Information

We do not sell your personal information. We do not share your personal information with third parties for their own independent marketing purposes.

We may share information in these limited circumstances:

Service providers. We use vendors who perform services on our behalf — website hosting, form processing and email delivery, phone and text messaging services, electronic health record and scheduling software, payroll and background-check vendors, and analytics and advertising platforms. These vendors may access information only as needed to perform their work for us and are required to protect it.

Care coordination and payers. With your authorization or as permitted by law, we may share information with the parties necessary to arrange or pay for your care — for example, Georgia Department of Community Health programs, CCSP or SOURCE care coordination agencies, Medicaid, long-term care insurers, workers’ compensation carriers, or the U.S. Department of Veterans Affairs. Health information shared for these purposes is handled under HIPAA and our Notice of Privacy Practices.

Legal and safety. We may disclose information when required by law, subpoena, court order, or government or licensing authority request; to establish or defend legal claims; to comply with mandatory reporting obligations, including elder abuse or neglect reporting; or to protect the safety of any person.

Business transfers. If A Caring Touch for Seniors, LLC is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Privacy Policy.

Again: none of the above categories includes text messaging opt-in data or consent. That information is never shared with any third party.

8. How Long We Keep Information

We keep personal information only as long as necessary for the purposes described in this policy and to meet our legal, licensing, accreditation, tax, and recordkeeping obligations. Client care records are retained for the period required by Georgia law and applicable program rules. Website inquiry data from people who do not become clients is retained for a reasonable period for follow-up and recordkeeping, and is deleted or de-identified thereafter. Employment application records are retained in accordance with applicable federal and Georgia employment law.

9. How We Protect Information

We use administrative, technical, and physical safeguards designed to protect the information we hold. Our website is served over an encrypted HTTPS connection. Access to personal information is limited to staff and vendors who need it to do their jobs, and our workforce receives privacy and confidentiality training.

No method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security. Please do not send Social Security numbers, Medicaid or insurance identification numbers, medical records, or other sensitive information through our website forms or by unencrypted email.

10. Your Choices and Rights

You may:

  • Ask what we hold. Request a copy of the personal information we have about you.
  • Correct it. Ask us to fix information that is inaccurate or incomplete.
  • Ask us to delete it. Request deletion of personal information, subject to our legal and recordkeeping obligations. We generally cannot delete client care records within required retention periods.
  • Opt out of marketing. Click “unsubscribe” in any marketing email, reply STOP to any marketing text, or contact us directly.
  • Opt out of tracking. Use the cookie and advertising opt-outs listed in Section 4.

If you are or have been a client, your rights regarding your protected health information — including the right to access, amend, and receive an accounting of disclosures — are described in our HIPAA Notice of Privacy Practices, which controls over this section for that information.

Georgia residents: state privacy law in Georgia continues to develop. Where a Georgia or federal law grants you additional rights, we will honor those rights as required.

11. Age Requirement and Children’s Privacy

This Site is intended for adults age 18 and over. Our services are arranged by adults, our forms are meant to be completed by adults, and we ask that no one under 18 submit information to us. If you are under 18, please have a parent or guardian contact us on your behalf.

As required by the federal Children’s Online Privacy Protection Act (COPPA), we also confirm that we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us at info@acaringtouchforseniors.com and we will delete it.

12. Job Applicants

Information you submit through our employment application is used solely to evaluate your application, communicate with you about it, conduct required background and credential verification, and — if you are hired — administer your employment. We do not use employment application information for marketing. We do not sell it. Background checks and required health screenings are conducted through vendors bound to protect your information.

13. Links to Other Websites

Our Site links to third-party websites, including Facebook, Instagram, YouTube, and Google. We are not responsible for the privacy practices or content of those sites. Review their privacy policies before providing information to them.

14. Do Not Track

Some browsers offer a “Do Not Track” setting. There is no consensus industry standard for responding to it, and our Site does not currently respond to Do Not Track signals. We do honor Global Privacy Control (GPC) signals where technically feasible, as described in Section 4.

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top. Material changes will be highlighted on the Site. Your continued use of the Site after an update means you accept the revised policy.
